The fiscal year for immigration is approaching on September 30th and EB-5 regional centers are required to file the Annual Certification of Regional Center Form I-924-A. The submission of form I-924-A allows the legal designation of a regional center to continue for another fiscal year.

If a regional center was recently designated as such prior to September 30th, they are also required to submit Form I-924-A. It is worth noting that the USCIS has also implemented a filing fee of $3,035 for the I-924-A form and has increased its analysis of qualifying designated regional centers.

Designated regional centers are encouraged to pay close attention to their filings of Form I-924A to avoid negative consequences from the USCIS. Despite original lenience, the USCIS is now being more careful with designated regional centers that are no longer promoting economic activity in their areas. Regional centers that fail to show extensive evidence of continual activity and economic stimulation will be issued a Notice of Intent to Terminate form by the USCIS. The filing period for Form I-924A is from October 1st – December 29th and the form can be downloaded here: http://www.uscis.gov/i-924a
